Allgemeine Geschäftsbedingungen (AGB)
1. Anbieter & Geltungsbereich
Anbieter und Lizenzgeber ist Gillian Scharf, Kudlichgasse 21/7, 1100 Wien, Österreich (support@oneclicklut.com). Diese AGB regeln die Nutzung von oneclicklut.com und der dort angebotenen digitalen Produkte.
2. Vertragsgegenstand
OneClickLUT ist ein digitales Produkt: ein Paket aus einem Final-Cut-Pro-Plugin, mehreren LUT-Dateien (.cube) und einem Installer, ausgeliefert als digitaler Download. Funktionsumfang und Kompatibilität ergeben sich aus der Produktbeschreibung auf der Website.
3. Kaufabwicklung über Polar (Merchant of Record)
Der Verkauf wird über Polar (Polar Software, Inc.) als „Merchant of Record" abgewickelt. Vertragspartner für den Kauf ist Polar; Polar wickelt Zahlung, Rechnungsstellung und Umsatzsteuer ab. Für den Kaufvorgang gelten ergänzend die Bedingungen und Richtlinien von Polar. Gillian Scharf räumt die Nutzungslizenz am Produkt ein (Punkt 6).
4. Preise & Zahlung
Es gelten die zum Zeitpunkt der Bestellung im Polar-Checkout angezeigten Preise inkl. der jeweils anfallenden Umsatzsteuer (Abwicklung durch Polar als MoR). Die Zahlung erfolgt über die im Polar-Checkout angebotenen Methoden.
5. Lieferung
Die Bereitstellung erfolgt digital unmittelbar nach erfolgreicher Zahlung (Download bzw. Zugang zur Datei). Es fallen keine Versandkosten an.
6. Lizenz & Nutzungsrechte
Mit dem Kauf erhält der Kunde eine einfache, nicht übertragbare Lizenz zur Nutzung des Produkts für unbegrenzt viele eigene private und kommerzielle Projekte. Nicht gestattet sind Weiterverkauf, Weitergabe, Vervielfältigung oder öffentliche Zugänglichmachung der LUT-/Plugin-Dateien sowie die Weitergabe von Download-Links. Die Urheberrechte am Produkt verbleiben bei Gillian Scharf.
7. Rücktrittsrecht bei digitalen Inhalten
Es handelt sich um digitale Inhalte mit sofortiger Bereitstellung. Das gesetzliche Rücktrittsrecht (FAGG) erlischt, sobald der Kunde im Checkout ausdrücklich zustimmt, dass mit der Ausführung sofort begonnen wird, und zur Kenntnis nimmt, dass er dadurch sein Rücktrittsrecht verliert (diese Zustimmung wird im Polar-Checkout eingeholt). Allfällige Rückerstattungen richten sich nach den Bedingungen von Polar als Merchant of Record.
8. Gewährleistung & Haftung
Das Produkt wird mit der auf der Website beschriebenen Funktion bereitgestellt. Ein bestimmtes ästhetisches Ergebnis kann nicht garantiert werden, da das Resultat von Aufnahme, Belichtung und Ausgangsmaterial abhängt. Für Inkompatibilitäten außerhalb der angegebenen Systemvoraussetzungen wird keine Haftung übernommen. Die Haftung ist auf Vorsatz und grobe Fahrlässigkeit beschränkt; zwingende gesetzliche Gewährleistungs- und Konsumentenschutzbestimmungen bleiben unberührt.
9. Updates
Im beschriebenen Umfang sind kostenlose Updates enthalten. Ein Anspruch auf bestimmte künftige Funktionen besteht nicht.
10. Anwendbares Recht & Streitbeilegung
Es gilt österreichisches Recht unter Ausschluss der Verweisungsnormen. Zwingende Schutzbestimmungen am gewöhnlichen Aufenthaltsort des Verbrauchers bleiben unberührt. EU-Online-Streitbeilegung: ec.europa.eu/odr.
11. Schlussbestimmungen
Sollte eine Bestimmung unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

1. Provider & scope
The provider and licensor is Gillian Scharf, Kudlichgasse 21/7, 1100 Vienna, Austria (support@oneclicklut.com). These Terms govern the use of oneclicklut.com and the digital products offered there.
2. Subject of the contract
OneClickLUT is a digital product: a package consisting of a Final Cut Pro plugin, several LUT files (.cube) and an installer, delivered as a digital download. Scope and compatibility are as described on the website.
3. Purchase handled by Polar (Merchant of Record)
Sales are processed by Polar (Polar Software, Inc.) as Merchant of Record. The contractual seller for the purchase is Polar; Polar handles payment, invoicing and VAT/tax, and its terms and policies additionally apply to the purchase. Gillian Scharf grants the license to use the product (see Section 6).
4. Prices & payment
The prices shown at the time of order in the Polar checkout apply, including any applicable VAT/tax (handled by Polar as MoR). Payment is made via the methods offered in the Polar checkout.
5. Delivery
The product is delivered digitally immediately after successful payment (download or access to the file). No shipping costs apply.
6. License & usage rights
With the purchase, the customer receives a non-exclusive, non-transferable license to use the product for an unlimited number of personal and commercial projects. Reselling, redistributing, copying or publicly sharing the LUT/plugin files, as well as sharing download links, is not permitted. Copyright in the product remains with Gillian Scharf.
7. Right of withdrawal for digital content
This is digital content supplied immediately. The statutory right of withdrawal expires once the customer expressly agrees, at checkout, that performance begins immediately and acknowledges thereby losing the right of withdrawal (this consent is obtained in the Polar checkout). Any refunds are governed by the terms of Polar as Merchant of Record.
8. Warranty & liability
The product is provided with the functionality described on the website. A specific aesthetic result cannot be guaranteed, as the outcome depends on recording, exposure and source footage. No liability is accepted for incompatibilities outside the stated system requirements. Liability is limited to intent and gross negligence; mandatory statutory warranty and consumer-protection provisions remain unaffected.
9. Updates
Free updates are included to the extent described. There is no entitlement to specific future features.
10. Applicable law & dispute resolution
Austrian law applies, excluding its conflict-of-law rules. Mandatory consumer-protection provisions of the consumer's country of habitual residence remain unaffected. EU online dispute resolution: ec.europa.eu/odr.
11. Final provisions
Should any provision be invalid, the validity of the remaining provisions remains unaffected.
